Police ID Fort Myers Woman Killed in St. Petersburg Car Accident

Police have identified a Fort Myers woman killed in a St. Petersburg car accident Wednesday.

According to officials with the Florida Highway Patrol, 77 year-old Karen Hay was killed Wednesday afternoon when her vehicle crossed the center lane of interstate 75 and slammed into an oncoming truck near North Port. Police say Hay was driving south near mile marker 180 shortly before 2:00 p.m. when her vehicle drifted out of the southbound lanes, crossed the median, and moved into the path of a northbound semi-tractor-trailer.

The driver of the tractor-trailer, Sarasota-resident Ramiro Vidal, swerved toward the shoulder to avoid a collision, but the front of Hay's car collided with the truck, a Florida Highway Patrol spokesperson said.

Hay was transported by Bayflite to Bayfront Medical Center in St. Petersburg following the crash, where she later succumbed to her injuries.

The northbound lanes of Interstate 75 were closed for two hours while crews worked to clean up the accident.

New Florida Law Makes Slip and Fall Cases Harder to Prove

A new Florida law, which took effect July 1st, will make plaintiffs' (victims) slip and fall cases harder to prove. The rule requires the plaintiff to prove that the venue either knew of, or should have know about whatever substance caused the fall and failed to do something about it.

Previously, one only had to prove that a substance that did not belong there caused the fall. The law, House Bill 689, is supposed to even the grounds for businesses and consumers in these cases.

Some attorneys are afraid of the consequences this law will have on the injured. Paul Jess of the Florida Justice Association says that it is tough for clients to figure out how long the foreign substance was on the floor when they are dealing with their actual injuries. Instead of encouraging companies to conduct investigations, this law encourages a lack of action, which makes it tougher for a victim to prove their case.

Man charged with DUI manslaughter

A 25-year-old St. Petersburg man has been charged with DUI manslaughter ten months after the death of his then-girlfriend in a drunk driving accident.

The woman was killed last July when she stuck her head out of the man's car, striking several mailboxes and suffering head injuries. 

The man said the woman "was just hanging out the window, had her head out having fun and didn't see the mailboxes."

He waived his Miranda rights at the time of arrest in July, claiming he had "nothing to hide because he was not drinking or using drugs.'

Police report otherwise, with evidence that he had a blood alcohol level of 0.12 three hours after the accident. The legal limit is 0.08. 

Teenage passenger killed in crash

A Plant City teenager was killed around 11:20 p.m. in a crash in the westbound lanes about a mile east of McIntosh road on Interstate 4 Sunday night. 

The 17-year-old was the passenger in a 1990 Nissan 300ZX driven by his 19-year-old friend, who was seriously injured and transported to Tampa General Hospital. 

The teenage driver attempted to overtake another car, before swerving out of control and careening off the road, taking the other vehicle with him. The 63-year-old driver of the other car was taken to Bradenton Regional Hospital in serious condition.

Neither teen was wearing a seatbelt. It has not been determined if alcohol was involved in this accident.

St. Petersburg teen cyclist collides with truck

According to police reports, a St. Petersburg teen struck a pickup truck as he crossed Fifth Avenue on Monday afternoon. The driver of the 1999 Toyota Tacoma truck was unharmed. The teen remains in stable but critical condition in All Children's Hospital.

This accident accentuates the importance of vehicle-bicycle safety precautions. Cyclists should be sure to take their time in crossing streets and drivers exhibit patience in passing cyclists.
